This website is operated by Pochy Jewelry 1 LLC, doing business as Pochy Jewelry. Throughout the website, the terms “we,” “us,” and “our” refer to Pochy Jewelry.

By visiting our website, placing an order, or using any of our products or services, you agree to these Terms of Service and all additional policies referenced herein, including our Refund Policy, Shipping Policy, Privacy Policy, warranty terms, and any product-specific conditions.

Please read these Terms carefully before using our website or placing an order. If you do not agree to these Terms, you may not access the website or use our services.

ONLINE STORE TERMS

By agreeing to these Terms, you represent that you are at least the age of majority in your state, province, or country of residence or that you have authorized a minor dependent to use this website under your supervision.

You may not use our products, website, or services for any illegal or unauthorized purpose. You may not transmit viruses, malicious code, or any other material that could damage or interfere with the website or its users.

You may not reproduce, duplicate, copy, sell, resell, or exploit any portion of the website, its content, our products, or our services without our prior written authorization.

ORDER ACCEPTANCE AND VERIFICATION

Submitting an order does not guarantee its acceptance. We reserve the right to decline, cancel, limit, or place an order on hold when reasonably necessary, including in cases involving:

  • Suspected fraud or unauthorized payment

  • Incorrect pricing or product information

  • Failed identity or payment verification

  • Unavailable materials or products

  • Shipping restrictions

  • Previous payment disputes or policy violations

For fraud-prevention purposes, we may request identification, payment authorization, proof of address, or other documentation before beginning production or shipping an order. Failure to provide the requested information may result in the order being delayed or canceled.

If we cancel an order before production due to an error or inability to fulfill it, we will issue the appropriate refund to the original payment method.

PRODUCT AVAILABILITY AND PRICING

All products and materials are subject to availability. We reserve the right to limit quantities, discontinue products, or refuse orders at our discretion where permitted by law.

Jewelry prices may change without notice due to changes in precious-metal prices, gemstone costs, labor, market conditions, or other factors. A price change will not affect an order that has already been accepted unless the original price resulted from an obvious error.

We reserve the right to correct pricing, weight, configuration, description, or technical errors. If an error affects an order you placed, we will contact you before fulfillment and provide the available options.

Discount codes cannot be combined unless expressly stated otherwise. Discounts have no cash value and cannot be applied retroactively after an order has been placed.

PRODUCT INFORMATION AND HANDCRAFTED VARIATIONS

We make reasonable efforts to display product descriptions, photographs, colors, dimensions, weights, and specifications accurately. However, colors and appearance may vary depending on lighting, photography, screen settings, and the characteristics of the materials.

Many Pochy Jewelry pieces are individually handmade. Minor differences in link shape, dimensions, finish, soldering, polish, color, weight, or other details are natural characteristics of handcrafted jewelry and do not automatically constitute defects.

Product weights, millimeter measurements, widths, lengths, and gemstone weights shown on the website are approximate unless expressly guaranteed in writing. Final measurements and weights may vary reasonably because of manufacturing, polishing, sizing, clasp selection, stone setting, and other production factors.

Gold color may vary based on karat, alloy composition, lighting, and finishing. Natural gemstones may also vary in color, clarity, inclusions, and appearance.

Customers with known metal sensitivities or allergies should contact us before ordering. Unless expressly stated otherwise, we do not represent that an item is hypoallergenic or free from a specific alloying metal.

CUSTOM AND MADE-TO-ORDER PRODUCTS

Custom and made-to-order products may include Cuban link chains, Cuban link bracelets, personalized jewelry, custom pendants, engravings, special lengths, special widths, selected karats, stone selections, clasp modifications, and other pieces manufactured or modified according to a customer’s selections.

The customer is responsible for reviewing all order specifications before submitting the order, including:

  • Karat and metal color

  • Length and width

  • Clasp or lock selection

  • Engraving and spelling

  • Stone type and placement

  • Finish and other customization details

Production may begin shortly after an order is accepted. Requested changes are not guaranteed after the order has been placed. Approved changes may result in additional charges and may restart or extend the production timeframe.

Cuban Link Jewelry is made to order and can have final weights that range up to 10 grams (+ or -). If the weight is greater than expected, an invoice for the difference will need to be paid before shipping. If the weight is lower, the customer will be reimbursed accordingly.

Personalized, engraved, specially designed, or otherwise uniquely customized items are final sale except where otherwise required by law or expressly agreed to in writing by Pochy Jewelry.

PRODUCTION TIMEFRAMES

Production timeframes displayed on product pages or communicated by our team are estimates based on the product, customization, material availability, and current workload. Production estimates are separate from carrier transit times and are not guaranteed delivery dates.

Unless expressly stated otherwise, the day an order is placed does not count as the first production day. Business days are Monday through Friday, excluding federal holidays and days when our workshop is closed.

Production may be delayed by payment verification, customer-requested changes, unavailable materials, additional quality-control work, weather events, carrier disruptions, or other circumstances beyond our reasonable control.

Rush production fees apply only to the production timeframe and do not guarantee a specific carrier delivery date. Shipping delays caused by the carrier are outside Pochy Jewelry’s direct control.

CANCELLATIONS

To request a cancellation, contact info@pochyjewelry.com as soon as possible.

All approved cancellations are subject to a 3% payment-processing fee, which will be deducted from the refund because payment-processing costs are not returned to us by the payment processor.

Cancellation requests submitted within 24 hours of placing the order will only incur the 3% payment-processing fee.

After the initial 24-hour period:

  • Custom, personalized, and made-to-order products are subject to the 3% payment-processing fee plus a 20% cancellation fee.

  • Regular, non-custom products are subject to the 3% payment-processing fee plus a 6% cancellation fee.

Cancellation requests are not complete until approved by Pochy Jewelry. Orders that have already shipped cannot be canceled and will instead be subject to the applicable return or exchange policy.

Orders manufactured using gold, silver, gemstones, or other materials supplied by the customer are final and cannot be canceled or refunded once accepted.

These cancellation conditions apply except where prohibited by applicable law or where a payment provider’s governing terms require different treatment.

RETURNS AND EXCHANGES

Pochy Jewelry generally offers exchanges—not refunds—subject to the conditions contained in our Refund Policy.

For eligible products:

  • Exchange requests must be submitted within 7 days of delivery.

  • Products must be unused, unworn, unaltered, undamaged, and returned with their original packaging and accessories.

  • Items showing wear, damage, modification, missing components, or signs of improper handling will not qualify.

  • An exchange is not approved until the product is received and inspected by Pochy Jewelry.

Standard made-to-order Cuban link chains or bracelets may be considered for an exchange involving a different size or length of equal or greater value, subject to inspection and approval. The customer is responsible for applicable price differences, labor, shipping, insurance, and other adjustment costs.

Fully custom-designed, engraved, personalized, altered, or uniquely manufactured products may not be returned or exchanged unless Pochy Jewelry determines that the item contains a covered manufacturing defect.

Original shipping charges, rush fees, customization charges, and other completed services are nonrefundable unless otherwise required by law.

Customers are responsible for securely packaging and insuring exchange shipments. Pochy Jewelry is not responsible for returned items lost or damaged before being delivered to us.

Purchases made through Klarna or another financing provider may be subject to additional or different requirements. If the provider’s applicable terms give the customer additional rights, those terms will apply.

REFUNDS

When a refund is approved, it will generally be issued to the original payment method. Bank and payment-provider processing times may vary, and Pochy Jewelry cannot control how quickly the credit appears after the refund has been submitted.

Any applicable cancellation fees, payment-processing fees, shipping charges, rush fees, completed services, or other nonrefundable amounts will be deducted as permitted by these Terms and applicable law.

CUSTOMER-SUPPLIED GOLD, SILVER, OR OTHER MATERIALS

Orders involving customer-supplied gold, silver, gemstones, or other materials are final sale and are not eligible for cancellation or refund once accepted.

The customer represents that they legally own the supplied materials and have the authority to provide them to Pochy Jewelry.

Melting, refining, alloying, casting, soldering, polishing, and manufacturing can result in normal material loss. Additional metal or alloying material may also be required to complete the requested piece. Applicable charges and credits will be determined based on the condition, purity, usable weight, and requirements of the project.

Pochy Jewelry is not responsible for undisclosed treatments, fillers, impurities, previous repairs, incorrect karat representations, or structural weaknesses in customer-supplied materials.

SHIPPING AND DELIVERY

Customers are responsible for providing a complete and accurate shipping address. Address changes are not guaranteed after an order has been placed and may require additional verification.

High-value shipments may require an adult signature. Customers are responsible for making suitable arrangements to receive the package.

Estimated delivery dates are not guaranteed. Pochy Jewelry is not responsible for carrier delays caused by weather, service interruptions, customs, incorrect addresses, unsuccessful delivery attempts, or circumstances beyond our reasonable control.

Customers must promptly notify us of packages that arrive damaged, appear tampered with, or are not received despite being marked as delivered. Photographs, video, packaging, carrier documentation, or other information may be required to investigate a claim.

International customers are responsible for applicable customs duties, taxes, brokerage charges, and import restrictions unless expressly stated otherwise.

WARRANTY AND REPAIRS

Any warranty provided by Pochy Jewelry is subject to its stated conditions and inspection of the jewelry.

Unless specifically covered by an applicable written warranty, coverage does not include:

  • Normal wear, scratches, or loss of polish

  • Accidental damage or misuse

  • Bent, stretched, broken, or damaged links caused by force

  • Lost or damaged stones resulting from impact or wear

  • Improper cleaning, storage, or maintenance

  • Unauthorized alterations or repairs

  • Damage caused by another jeweler or third party

  • Loss, theft, or disappearance of the item

Pochy Jewelry must inspect the item before determining whether a condition is covered. Shipping, insurance, replacement parts, stones, sizing, refinishing, or other services may involve additional charges.

THIRD-PARTY PAYMENT AND FINANCING SERVICES

Payments or financing offered through Klarna, Affirm, Shop Pay Installments, PayPal, or other third-party providers may be governed by additional agreements between the customer and that provider.

Pochy Jewelry does not control financing approvals, payment schedules, interest charges, account decisions, or other actions taken by third-party providers. Customers remain responsible for complying with the terms of their financing or payment agreement.

PAYMENT DISPUTES AND CHARGEBACKS

If you believe there is a problem with an order or transaction, please contact us first so we can attempt to resolve it.

When responding to a payment dispute or chargeback, Pochy Jewelry may provide the payment provider with relevant records, including order details, customer approvals, policy acceptance, correspondence, production records, photographs, shipping information, signature confirmation, and delivery documentation.

Nothing in this section limits any rights that cannot legally be waived.

USER COMMENTS, FEEDBACK, AND SUBMISSIONS

If you submit comments, reviews, suggestions, photographs, ideas, or other materials, you agree that your submission will not violate any third party’s copyright, trademark, privacy, publicity, or other rights.

You may not submit unlawful, abusive, misleading, defamatory, obscene, or malicious content or any computer virus or malware.

Except for personal information governed by our Privacy Policy, feedback and suggestions may be used by Pochy Jewelry without compensation or an obligation to maintain them in confidence.

PERSONAL INFORMATION

Your submission and our handling of personal information are governed by our Privacy Policy.

By placing an order or communicating electronically with us, you consent to receive communications related to your transaction, including verification requests, production updates, shipping notices, and customer-service messages.

Marketing communications are subject to the consent and opt-out options provided when you subscribe.

PROHIBITED USES

You may not use the website or its content:

  • For an unlawful or fraudulent purpose

  • To encourage others to perform unlawful acts

  • To violate any applicable law or regulation

  • To infringe our intellectual-property rights or the rights of others

  • To harass, abuse, threaten, defame, or discriminate

We do not guarantee that the website will always be uninterrupted, secure, error-free, or available or that all information will always be complete or current.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Pochy Jewelry and its owners, employees, affiliates, contractors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the use of the website, products, or services.

Where liability cannot legally be excluded, Pochy Jewelry’s total liability will be limited to the amount paid for the product or service giving rise to the claim, except where a different limitation is required by law.

Nothing in these Terms excludes liability or consumer rights that cannot legally be excluded or limited.

INDEMNIFICATION

You agree to indemnify and hold harmless Pochy Jewelry and its affiliates, owners, officers, employees, agents, contractors, licensors, and service providers from claims, liabilities, damages, and reasonable expenses arising from your violation of these Terms, misuse of the website, infringement of another party’s rights, or violation of applicable law.

TERMINATION

We may suspend or terminate your access to the website if you violate these Terms or use the Service in a fraudulent, abusive, unlawful, or harmful manner.

Any obligations and liabilities incurred before termination will survive termination where applicable.

SEVERABILITY

If any provision of these Terms is determined to be unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law. The remaining provisions will remain valid and enforceable.

ENTIRE AGREEMENT

These Terms and the policies referenced herein constitute the entire agreement between you and Pochy Jewelry concerning your use of the website and purchase of products or services.

If a product listing or written custom-order agreement contains terms specific to an order, those specific terms will control over conflicting general terms.

CHANGES TO THESE TERMS

We reserve the right to update these Terms by posting a revised version on this website. Changes will become effective when posted unless otherwise stated.

The Terms applicable to an order will generally be the version in effect when the order was placed, except where a change is required by law.

GOVERNING LAW

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles.

Subject to applicable consumer-protection laws, disputes relating to these Terms or a purchase from Pochy Jewelry will be brought in a court of competent jurisdiction located in Miami-Dade County, Florida.
